Court Fight Over Guard Activation

In an immediate request, the justice department asked the bench to reverse a previous judicial decision that had stopped the stationing of hundreds of military reserve personnel to the greater Chicago.

Administration's Claims

The solicitor general, acting for the government, claimed in the recent request that federal agents have frequently been “menaced and attacked” in the city of Chicago and the suburb of Broadview.

The president has earlier deployed military reserve forces to the Windy City and Portland, after earlier activations to LA, the city of Memphis, and Washington, District of Columbia.

The administration has claimed that armed forces involvement is necessary to curb unrest and bolster border control.

Legal Basis

At the core of the conflict is the government's invocation of a US code allowing the commander-in-chief to nationalize the state guard only in cases of rebellion or when “powerless with the standard military to carry out the regulations of the United States”.

The White House argues that the personnel are necessary to safeguard US facilities and officers from protesters.

Earlier this month, the White House nationalized three hundred personnel of the Illinois national guard and commanded additional Texas-based personnel into the state.

As state authorities denounced the decision, the White House escalated his rhetoric, calling on the apprehension of the mayor of Chicago and the state's chief executive, each a Democrat, charging them of failing to secure ICE personnel.

State authorities and Chicago together took legal action against the government to halt the deployment.
